OFFICIAL RULES

THIS CONTEST IS OPEN TO RESIDENTS OF ONTARIO ONLY WHO ARE LEGAL DRINKING AGE
AND IS GOVERNED BY CANADIAN LAW

The “Muskoka Brewery Great Glamping Adventure Contest” (the “Contest”) is governed by these official rules (the “Official Rules”), which are available online at http://glampingadventure.com from June 13, 2019 at 12:00 a.m. ET to September 6, 2019 at 11:59 p.m. ET. By participating in the Contest, each entrant agrees to be legally bound by these Official Rules, including without limitation all eligibility requirements, and understands that the Sponsor’s (defined below) decisions in connection with the Contest are final and binding in all respects. The Contest is subject to all federal, provincial and local laws and regulations and is void where prohibited by law.

1. SPONSOR:

This Contest is sponsored by Lakes of Muskoka Cottage Brewery Inc. o/a Muskoka Brewery, 1964 Muskoka Beach Rd., Bracebridge, ON P1P 1R1 (the “Sponsor”).

2. CONTEST PERIOD:

The entry period for the chance to win a Prize (defined below) begins on June 13, 2019 at 12:00 am Eastern Time (“ET”) and ends on September 6, 2019 at 11:59:59 p.m. ET (the “Contest Period”).

3. ELIGIBILITY, RESIDENCY AND AGE:

To be eligible, you must be a resident of Ontario who has reached the legal drinking age in Ontario (19). You are not eligible if you are: a) an employee, representative or agent of the Sponsor, its parent company, subsidiaries, affiliates, contest agencies, production agencies and/or any other entity involved in the administration or execution of the Contest (collectively, the “Contest Parties”); b) employees of any liquor agencies, boards, commissions, branches, liquor retailers, alcohol beverage or distributors/wholesalers; or c) a member of the immediate family (defined as spouse, siblings, children, in-laws, grandparents, grandchildren) or household of any of the above persons.

4. HOW TO ENTER:

NO PURCHASE IS NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.

STEP 1: OBTAIN AN ENTRY CODE: During the Contest Period, an eligible entrant may obtain an entry code (“Code”) to enter the Contest using one (1) of the following three (3) methods:

A. Purchase participating Muskoka Brewery product: During the Contest Period, entrants may purchase a specially-marked 4 pack or 12 pack case of Muskoka Brewery Detour, Cream Ale, Craft Lager, Mad Tom IPA or Ebb and Flow beer available at participating retailers while supplies last, and obtain a unique Code printed on the inside of the sticker found on the case. Each unique Code may be used only one (1) time during the Contest Period.

B. Visit participating licensed establishments or licensed events: During the Contest Period, entrants may receive a Contest scratch card from participating licensed establishments and events in Ontario, available while supplies last. Scratch the card to reveal the unique Code. Each unique Code may be used only one (1) time during the Contest Period. See Appendix A for a list of participating establishments and events. The Sponsor reserves the right to update or modify this list at any time.

C. Without a Purchase Online: To obtain a Code, while supplies last, without making a purchase or visiting a participating licensed establishment or licensed event, visit http://glampingadventure.com (“Website”) and follow the on-screen prompts to “Get a Code”. Once you have entered the requested information you will be sent an email included on the request form with a unique Code. All requests must be submitted no later than September 4, 2019 at 11:00 am ET to allow adequate time for processing. Please allow up to one (1) day to receive a Code. Proof of submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected requests or Codes. Use (or attempted use) of automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise to request a Code is prohibited and is grounds for disqualification by the Sponsor. Each unique Code may be used only one (1) time during the Contest Period.

STEP 2: ENTER THE CODE ON THE CONTEST WEBSITE
During the Contest Period, an eligible entrant must visit http://glampingadventure.com (“Website”) and follow the on-screen prompts to the Contest. To enter the Website, entrants must confirm they are legal drinking age and resident of Ontario. The entrant must complete and submit the entry form by providing the information requested by Sponsor which may include, but not be limited to: complete first and last name, address (P.O. Boxes are not permitted), daytime phone number, valid e-mail address, indication of acceptance of these Official Rules and their unique Code.

Once an entrant has submitted a unique and valid Code legitimately obtained in accordance with these Official Rules, the entrant will automatically be entered for a chance to win the Grand Prize and the Secondary Prize (as described below). In addition, the entrant will be notified on screen and via email if they are the eligible winner of an Instant Win Prize (as described below), subject to verification. If you are an eligible Instant Prize winner, you will receive additional information on how to claim the Instant Win Prize, as described in below.

LIMITS: There is no limit to the number of entries per person during the Contest Period, provided each entry includes a unique Code. Entrants can only use one (1) email address to enter the Contest. Use (or attempted use) of multiple names, identities, email addresses, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor.

All entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification and original entry Code) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. Any Codes or any other materials used in this Contest which have been tampered with, mutilated, altered, forged, reproduced, not legitimately obtained, are illegible or which contain or reflect printing, production or other errors will be void.

The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s). All decisions of the Sponsor are final and binding.

In the event of a dispute as to the identity of an entrant, the entry will be declared made by the primary account holder of the account associated with the e-mail address used. The “primary account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the e-mail address holder.

IMPORTANT: Message and data rates may apply if an entrant enters this Contest on his/her mobile device. Entrants should consult their wireless provider’s pricing plans. Mobile entry is not required to enter or win a prize in this Contest.

5. PRIZE WINNER SELECTION

A. Instant Win Prize Winner Selection:
When an entrant enters a Code as set out in section 4 above, he/she will automatically be eligible for a chance to win one of two hundred Instant Win Prizes (as described below). Each of the Instant Win Prizes will be associated with a time-stamp for a pre-determined time during the Contest Period that has been randomly selected by the Sponsor at its sole discretion. The first eligible person who enters a Code on or after the time-stamp associated with an Instant Win Prize will be deemed the potential winner of an Instant Win Prize. The odds of winning an Instant Win Prize will depend on the number and timing of eligible entries received during the Contest Period. If an entrant is eligible to win an Instant Win Prize, they will be notified on screen and by email, and will be asked to respond to the email confirming their mailing address and answering a mathematical skill-testing question without assistance included in the email. Failure to correctly answer the skill-testing question will result in forfeiture of the prize. A forfeited Instant Win Prize will not be awarded. There is a limit of [1] Instant Win Prizes per person/email address throughout the Contest Period. By accepting an Instant Win Prize, each winner fully releases the Releasees (as defined below) from all liability in connection with this Contest and the awarding and use or misuse of the Instant Win Prize.

B. Grand Prize and Secondary Prize Winner Selection and Notification:

On September 9th, 2019 (the “Draw Date”) in Toronto, Ontario at approximately 1:00 p.m. ET, a random draw will be held from all eligible entries received during the Contest Period to select the potential Grand Prize and Secondary Prize winners. The first entrant drawn will be eligible to win the Grand Prize and the second entrant drawn will be eligible to win the Secondary Prize. The odds of winning the Grand Prize and Secondary Prize depend on the number of eligible entries received during the Contest Period.

The Sponsor or its designated representative will make three (3) attempts to contact each selected entrant by telephone or email (using the information provided at the time of entry) within ten (10) business days of the Draw Date. If the selected entrant cannot be contacted within three (3) attempts or ten (10) business days of the Draw Date (whichever occurs first), or there is a return of any notification as undeliverable; then the selected entrant will be disqualified (and will forfeit all rights to the prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries (in which case the forgoing provisions of this section shall apply to such new selected entrant).

Before being declared a Grand Prize or Secondary Prize winner, the selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within ten (10) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the prize as awarded; (iii) releases the Contest Parties, any applicable liquor authority, and each of their respective parent, officers, directors, employees, governors, owners, distributors, retailers, assignees, representatives and agents (collectively, the “Releasees”) from any and all liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of the selected entrant’s name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the internet. In addition to the requirements listed above, the Grand Prize and Secondary Prize winners may, before being awarded a prize, be required to sign a document in a form acceptable to the relevant liquor authorities releasing such liquor authorities and their directors, officers, employees and agents from all liability of any kind in connection with this Contest, or occurring as a result of the prize being awarded. If the selected entrant: (a) fails to correctly answer the skill-testing question; and/or (b) fails to return the properly executed Contest documents within the specified time, then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries (in which case the forgoing provisions of this section shall apply to such new selected entrant).

6. PRIZES:

Instant Win Prizes:
There are two hundred (200) instant win prizes (the “Instant Win Prizes”) each consisting of one Muskoka Brewery hat. Colour of hat at sole discretion of the Sponsor. The approximate retail value of each Instant Win Prize is $25 CAD.

Grand Prize:
There is one (1) grand prize trip for the winner and five (5) of his/her friends for a Glamping Adventure in Muskoka (the “Grand Prize”). The Grand Prize trip includes return transportation from a major gateway such as an airport or train station near to the winner’s residence in Ontario (mode of transportation and gateway determined by Sponsor in its sole discretion) to Muskoka, Ontario, two (2) nights glamping resort accommodation as selected by the Sponsor (based on three (3) sites, double occupancy), meals during the stay (including two lunches, two dinners, two breakfasts), a tour at Muskoka Brewery, recreational activities including but not limited to non-motorized water sports and motorized water sports, live entertainment and Muskoka Brewery Swag Packs including but not limited to merchandise and supplies. Total value of the Grand Prize is approximately $10,000 CAD, based on an Ottawa departure example. Should there be a difference between the actual retail value of the Grand Prize and the approximate value of the Grand Prize stated in the rules, the winner is not entitled to the difference, if any. Beverage alcohol is not part of the prize. The Grand Prize trip must take place from July 24 – 26th, subject to change at the sole discretion of the Sponsor.

Costs of everything not stated above as included in the Grand Prize are the responsibility of the winner, and without limiting the generality of this statement the following costs are the responsibility of the winner: transportation to and from the major gateway, all ground transportation in Muskoka, gratuities, health insurance, travel insurance, excursions, meals, beverages, in-room charges, items of a personal nature. Winner may be required to provide a valid credit card upon check in at hotel. Winner and travel companions must have all necessary documents, including government issued photo ID and identification to permit travel. It is recommended that winner and his/her traveling companions obtain sufficient insurance prior to departure.

The following general conditions apply to the Grand Prize: (i) winner and travel companions must travel on same itinerary on the dates specified by Sponsor; (ii) if the winner does not utilize any aspects of the trip, the trip and/or those aspects not utilized will be forfeited in their entirety and nothing will be substituted in their place; (iii) the Sponsor and/or its representatives reserve the right at any time to place reasonable restrictions on the availability or use of the prize or any aspect of the prize; (iv) travel arrangements may only be made through the Sponsor or its agents, travel at a particular time is subject to availability and once booked the trip dates cannot be changed; (v) by accepting the prize, the winner agrees to waive all recourse against the Releasees and agree that the Releasees shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the prize (including travel related thereto) and/or participation in this Contest, or if any part of the trip or any services that form part of the Grand Prize do not prove satisfactory, either in whole or in part; (vi) the winner’s traveling companions must all be legal drinking age in Ontario and each must sign and return to the Sponsor a release form indicating that they waive all recourse against the Releasees relating to their participation in the prize within the time-frame indicated by the Sponsor.

By entering this Contest and accepting the Grand Prize, the winner agrees to maintain his/her behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest – or prize-related activity. The Grand Prize winner understands and agrees that Sponsor or prize providers have the right, in their sole discretion, to disqualify and remove the Grand Prize winner and his/her guest from any activity at any time if the Grand Prize winner’s or his/her guest’s behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Contest Parties or otherwise violates the policies of the prize providers, and in such a case, the Grand Prize winner will still be solely responsible for all expenses related to the prize. Once selected by the Grand Prize winner, guests cannot be changed without the express consent of Sponsor, which may be withheld for any reason.

Secondary Prize
There is one (1) secondary prize (the “Secondary Prize”) consisting of a Dockside Draught kegerator unit. The approximate retail value of the Secondary Prize is $1,000.

The Instant Win Prizes, Grand Prize, and Secondary Prize are collectively referred to as the “Prizes”. Each Prize must be accepted as awarded. The Prizes are non-transferable, cannot be substituted for another prize, cannot be sold, and cannot be redeemed for cash. Notwithstanding the foregoing, the Sponsor reserves the right (at its sole and absolute discretion) to substitute any Prize for another prize of equal or greater value in the event the Prize is unavailable or for any other reason whatsoever. Allow 4-6 weeks after verification for shipment of the Secondary Prize and Instant Win Prize, to the addresses provided at the time of registration. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.

7. GENERAL CONDITIONS:

Without limiting the generality of any other provision of these Official Rules, by entering the Contest, each participant agrees to indemnify, release and hold harmless the Releasees from any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, participation in this Contest, or possession, acceptance and/or use or misuse of a Prize (if applicable) or participation in any Contest-related activity and/or claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.

By entering the Contest, entrants agree to abide by these Official Rules and the decisions of Sponsor which are final. By entering this Contest, and accepting a prize, entrants agree that Sponsor can use their name, voice, town, city, province/territory/state of residence, and/or photograph in any publicity or advertisement carried out by Sponsor, without further remuneration or notice, except where prohibited by law.

8. ADDITIONAL TERMS:

The Releasees are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, third party apps, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled, destroyed or delayed computer transmissions, Codes, Code requests, or other errors of any kind, whether human, mechanical or electronic, which may occur in the distribution of prizes in this Contest. The Releasees Parties are not responsible for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due Codes, Code requests, Contest related documents or prize notifications. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer and/or mobile phone related to or resulting from participating or downloading any material in the Promotion.

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest in accordance with the letter and spirit of these Official Rules. Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

Sponsor reserves the right, at its sole and absolute discretion to withdraw, amend or suspend this Contest (or to amend these Official Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules. Sponsor, at its sole and absolute discretion, reserves the right to cancel, amend or suspend this Contest, or to amend these Official Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. Subject to all applicable Canadian federal, provincial and municipal laws and regulations, these Official Rules govern all aspects of the Contest and are binding on all participants.

Sole liability for irregular Codes is limited to replacement with another Code, while supplies last. No more than stated number of prizes will be awarded. If for any reason, including, but not limited to, an administrative, printing, production, computer or other error or due to technical difficulties or incorrect announcements of any kind, more winning messages are distributed than are intended to be awarded according to these Official Rules, the intended winners will be awarded in a random drawing from among all verified Instant Win Prize claims received. Notice of such cancelation, termination, or modification of the Contest shall be posted on the Website.

In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules or other statements contained in any Contest-related materials (including without limitation any advertising or promotional materials), the terms and conditions of these Official Rules shall prevail, govern and control.

This Contest will be governed by the laws of the province of Ontario and the laws of Canada applicable therein. You consent to the exclusive jurisdiction and venue of the courts of the Province of Ontario for any disputes arising out of this Contest.

9. PRIVACY:

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry for the purpose of administering the Contest and in accordance with the Sponsor’s privacy policy https://shop.muskokabrewery.com/pages/terms-of-service. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

10. LIQUOR AUTHORITIES:

The provincial liquor authorities are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever with regard to any matter relating to this Contest.
